These Terms and Conditions apply to participation in Ridelah Himalayan Experience and Ridelah Himalayan Expeditions (hereinafter referred to as "the Rides"). By booking and participating in the Rides, you agree to the terms set forth below.
1. Service Provider
The Rides are organized by Ten Thousand Holdings Sdn Bhd (Malaysia) and Ridelah Pte Ltd (Singapore) (hereinafter collectively referred to as "the Companies").
2. Participant Acknowledgment and Risk Acceptance
a. Participation in the Rides involves risks, including but not limited to, accidents, personal injury, illness, delays, and other unforeseen events.
b. By booking and participating, you confirm that you:
Are in good health and physically capable of participating in the Rides.
Have the necessary riding skills, experience, and appropriate licenses (including an International Driving Permit if required).
Understand and accept the inherent risks involved in off-road and high-altitude motorcycle touring.
3. Indemnification
You agree to indemnify, defend, and hold harmless the Companies, their directors, employees, agents, affiliates, and subcontractors from and against any claims, liabilities, losses, damages, or expenses (including legal fees) arising out of your participation in the Rides, except where such claims are a result of gross negligence or wilful misconduct by the Companies. This indemnification does not limit any rights or remedies available to you under applicable consumer protection laws in Malaysia and Singapore.
4. Booking and Payment
a. Deposit: A deposit of RM999 (or S$326 incl. GST for payments collected at Ridelah Pte Ltd in Singapore) is required to confirm your booking.
b. Full Payment: The full payment is due 60 days prior to the departure date, provided the minimum participation number is met.
c. If full payment is not received by the due date, the Companies reserve the right to cancel your booking and retain your deposit.
5. Cancellation and Refunds
a. Cancellation by Participant:
60 days or more before departure: Full refund of payments made.
30-59 days before departure: 50% refund of payments made.
Less than 30 days before departure: No refund.
b. Cancellation by the Companies: If the Companies cancel the Ride due to insufficient participation, force majeure, or other unforeseen circumstances, you will receive a full refund of payments made. The Companies are not liable for additional costs incurred by participants, such as airfare or personal expenses.
c. Force Majeure: In the event of natural disasters, political unrest, pandemics, or other events beyond the control of the Companies, refunds will be issued at the Companies’ discretion after deducting any irrecoverable costs incurred.
6. Participant Obligations
a. You are responsible for obtaining and carrying necessary travel documents, visas, and permits.
b. You must adhere to all instructions provided by the ride leader and follow local laws and regulations.
c. Behavior and Conduct During Group Rides:
Cooperation with the Group: The Rides are group-based activities, often among participants meeting for the first time. Mutual respect, patience, and consideration for fellow riders are essential to ensuring a safe and enjoyable experience for everyone.
Disruptive Behavior: Participants causing disruption, engaging in reckless riding, or exhibiting behavior that endangers themselves or others may be removed from the Ride at the sole discretion of the ride leader or Companies without refund.
Examples of such behavior include, but are not limited to:
Ignoring ride leader instructions or safety protocols.
Engaging in aggressive or dangerous overtaking or riding.
Arguments, hostility, or disrespect towards other participants, ride leaders, or local communities.
Conflict Resolution: The Companies encourage open communication to resolve misunderstandings or conflicts during the Ride. Participants are expected to act in good faith and work towards maintaining a positive group dynamic.
7. Liability Limitations
The Companies’ liability is limited to the services explicitly stated in the Ride itinerary. The Companies are not liable for:
Loss, damage, or theft of personal property.
Delays, cancellations, or alterations due to unforeseen events.
Personal injury or death except where resulting from gross negligence or willful misconduct by the Companies.
8. Insurance
All participants are required to have adequate travel and medical insurance covering high-altitude motorcycle touring, including emergency evacuation and medical expenses. Proof of insurance may be requested before departure.
9. Amendments
The Companies reserve the right to modify the itinerary, services, or terms due to weather, road conditions, or other operational considerations. Such amendments will be communicated promptly, and efforts will be made to minimize disruptions.
10. Governing Laws and Disputes
These Terms are governed by the laws of Malaysia and Singapore, as applicable. Any disputes shall be resolved through mediation or arbitration under the applicable jurisdiction.
11. Force Majeure
The Companies are not responsible for cancellations, delays, or interruptions due to acts of God, government restrictions, natural disasters, or other circumstances beyond their control.
By participating in the Rides, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
